New Port Richey Police Officer Arrested

According to a Hernando County arrest report, a New Port Richey Police Officer, Francis (Frankie) Myles Downey III was arrested for Fleeing to Elude and Unlawful Speed for doing 86 in a 50 mph zone. Hernando County Deputy Mascitelli filed the report that follows concerning the arrest:

On 03/24/2016, at approximately 0234 hours, while patrolling Cortez Blvd and Deltona Blvd, I observed two motorcycles traveling at 86 and 89 MPH in a posted 50 MPH zone. This speed was confirmed utilizing my Agency Issued Radar, Serial Number XE11854.

I attempted to turn around as the motorcycles were heading eastbound on Cortez Blvd. It appeared the orange and black motorcycle was traveling at 89 MPH and that the black, lowered and stretched motorcycle with a bright blue headlight was traveling at 86 MPH. I activated my emergency lights, to which the motorcycles took off at a high rate of speed. One of the motorcycles appeared to be a black GXSR with a bright blue headlight and appeared to be lowered and stretched, the operator appeared to be wearing a black ICON vest and wearing what appeared to be a black helmet. The second motorcycle was an orange and black CBR. I observed the operator of that motorcycle to be wearing a lavender style jacket. I continued eastbound on Cortez Blvd.

As I crested the hill before Nightwalker Road, I retrieved the speed on the orange motorcycle, which was 120 in a 50 MPH zone and it appeared the black motorcycle was too far ahead to scan on radar. At this time I disengaged, turned off my emergency lights, and headed north on Nightwalker Road.

At approximately 0236 hours I was informed by dispatch that the orange motorcycle had crashed at Cortez and Winter Street. Dispatch advised the motorcycle’s operator ran westbound away from the motorcycle. Upon arrival to the accident, I observed Florida tag 31BLA attached to what appeared to be on an orange and black motorcycle, which appeared to be the same motorcycle which had fled. The motorcycle was registered to Co-Defendant Tiffany Brush.

At approximately 0255 hours I received a call from Bayfront Health Brooksville advising that the motorcycle operator/ Co-Defendant was receiving treatment. I made contact with the Co-Defendant, who spoke with me after I read her Miranda Rights. She advised she ran because she was scared and didn’t know what to do. The Co-Defendant advised that the second motorcycle operator I observed, who was operating the black stretched GXSR with the bright blue headlight, belonged to her boyfriend Francis “Frankie” Downey. The Co-Defendant advised that she was trying to keep up with the defendant, Francis Downey, who made the turn eastbound onto Wiscon from Cortez, however she lost control and fell. The Co-Defendant advised she was scared to tell me right away about the second operator, due to him being a New Port Richey Police Officer.

I made contact with a witness, Haley Jenkins, who advised that the defendant made contact with her via a Facebook phone call around 1031 hours and advised, “He was probably getting fired and arrested and when Tiffany saw the lights on the cop car she took off he tried keeping up with her because he was scared for her safety.” Haley provided a sworn written statement. I also observed the defendant’s Facebook page, which had a picture of him next to a black, lowered and stretched Suzuki GXSR motorcycle wearing a black helmet and a black ICON vest, which closely resembled the motorcycle and operator I observed.

Contact was later made with the defendant, Francis Downey, at the Hernando County Jail. I read the defendant his Miranda Rights, in which he quickly invoked his rights to legal counsel. A check of DAVID revealed that the defendant does in fact own a 2007 black Suzuki Motorcycle, which bears Florida tag 0786RS. The defendant was subsequently placed under arrest, given a court date of 04-19-2016, and provided two traffic citations for Unlawful Speed for 86 in a 50 and the second citation for Fleeing to Elude. A Traffic transmittal form was completed and left at the jail. The defendant was held on a $5,000.00 Bond.
